Cumming council amends alcohol ordinance to allow happy hours and limited-time specials

Planning and Zoning staff member Michael Marshall, who worked with Kevin Tallent on the draft amendment, told the council the changes would: remove the provision barring restaurants from delivering more than one alcoholic beverage to a single customer at a time; permit discounts across more than one category of alcohol; allow licensees to limit discounts to particular times of day rather than requiring a day-long discount; remove the restriction on unlimited drink packages at a fixed price; and clarify language around tastings so a tasting does not, by itself, cause a violation when regular service follows.
"Yes, sir. It'll allow happy hours," Marshall said when asked directly whether the amendment permits time-limited discounts.
Council members asked whether the city center's tenants had reviewed the language. Marshall said the amendment was drafted to address items raised by the city center, but council members noted no tenants had been shown a draft for comment. The council discussed how the prior code required a posted list of discounted items for an entire day and limited discounts to a single beverage; the amendment replaces that with the ability for licensees to choose the duration and scope of specials, such as discounts by time of day.
After discussion the council moved, seconded and voted to adopt the amendment; the motion carried 5-0. No changes to licensing fees or other regulatory requirements were reported in the meeting record. The amendment was described as administrative code language cleanup and a regulatory relaxation to give local businesses more marketing flexibility.
