ALRB approves March 5 minutes, adds KIND Farms subpoena-enforcement matter to closed session

The Agricultural Labor Relations Board on March 19 voted to approve its March 5 meeting minutes and unanimously added a subpoena-enforcement matter involving KIND Farms Corp. to the closed-session agenda.
At the start of the meeting the board approved the March 5, 2025 minutes after a motion and a second. "All those in favor, say aye," the chair said; the board responded in the affirmative and the minutes were approved.
Later the board voted to add a late matter to closed session under the Government Code provision cited during the meeting. The chair moved that, pursuant to the government code cited by staff, the board add "KIND Farms Corp, et al., 2023CE001 Salinas region" to closed-session consideration; Member Lightstone seconded. The motion carried on a unanimous "aye" vote and the board recessed into closed session.
General Counsel Julie Montgomery reported two recent settlements during the public meeting: in Region 2 the Wine Group, Inc. agreed to pay a total of $35,817 in back pay and provide supervisor training and notice remedies to resolve a complaint filed after workers alleged retaliation and working-condition issues; Region 1 settlements involving Durigo Brothers of California and Fanciful Company Inc. included an offer of reinstatement and $17,000 in back pay to the charging party. Montgomery said the Wine Group settlement was finalized on Feb. 27, 2025, and the Durigo/Fanciful settlement was reached on March 13, 2025.
The board received litigation updates from chief board counsel Laura Hike: the consolidated appellate matter in the Fifth District Court of Appeal (case numbers F088515 and F088520) remains pending; Wonderful Nurseries LLC has pending filings in federal district court and filed a special appeal request (filed shortly after the board's 5 p.m. deadline) that will be circulated to the board; and the board was served with the Chavez et al. complaint in Kern County Superior Court (BCB-25-100649) on March 6, with an answer due April 7, 2025.
After returning from closed session the board announced it will meet again Wednesday, March 26, at 10 a.m. via Zoom and in Sacramento. The meeting adjourned at 11:39 a.m. before recessing into closed session and reconvening briefly at 12:22 p.m.
