Omaha council approves three liquor licenses, delays three others amid neighborhood conditions

The Omaha City Council on an unspecified date approved three liquor licenses and postponed action on three others while seeking more engagement between applicants and neighborhoods.

Council members voted 7-0 to approve a Class C liquor license for Burrito Envy and Tequila Bar (6113 Maple Street) and a Class C liquor license for Godega Market (1917 South 60th Street, Suite 120). After negotiations with neighbors, the council also approved a Class A liquor license for a Y Family convenience store (7102 North 30th Street) with added conditions limiting single-container sizes and waiving a procedural rule to allow the amendment.

The approvals followed public testimony and, in the case of the Y Family store, a series of meetings between the applicant and the neighborhood association. Attorney Peng Li, representing the Y Family applicant, told the council the applicant had signed a written parking agreement and had agreed with neighborhood requests on the size of alcoholic containers to be sold. Peng Li said the store would limit sales to beer in containers of 24 ounces or larger and spirits in containers of 200 milliliters or larger, and that roughly 35% of inventory would be alcohol while 65% would remain grocery and household goods.

Nancy Garter, president of the Miller Park/Minne Lusa Neighborhood Association, thanked council members for the delay that allowed negotiations and said she was satisfied with the commitments. "They've also agreed to take care of something that we value greatly, which is keeping the property clean," Garter said.

Council members recorded the Y Family vote after an amendment added the size restrictions into the record and waiving Rule 7; the motion passed 7-0. The transcript shows Council Member Johnson moved to approve the Y Family license with conditions; the amendment to add the specific size restrictions was read into the record and seconded; the roll call recorded seven yes votes.

By contrast, the council postponed three license items to allow applicants to be present or to give neighborhoods more time for consultation. The council agreed to lay over Firewater Bridal's Class C license request (7007 Grover Street) for one week; the motion to postpone passed 7-0. A request for a Class D license for Shankar Food Mart (822 N. 40th Street) was laid over for one week after the applicant's attorney, Harry Perdersch, indicated the applicant would agree to some neighborhood-requested restrictions (for example, excluding single-serving shooters and limiting single 32-ounce containers), and the council sought the applicant's presence to confirm concessions; the motion passed 6-0 with one member absent. Council members likewise laid over Mega Saver's Class D license (6508 John J. Pershing Drive) for one week to allow the applicant to engage nearby neighborhood groups; that motion also passed 6-0.

Council members and staff asked clerks and finance staff to confirm applicants' tax and registration status during several hearings. Steve Curtis of City Finance confirmed Burrito Envy was current on restaurant taxes when asked during the Burrito Envy hearing.

Why it matters Local liquor licenses can affect neighborhood quality-of-life issues such as litter, parking and late-night disturbances. In several cases the council delayed votes to allow direct applicant–neighborhood negotiations, and in one case approved a license only after the applicant agreed to size and stocking limits that neighborhood leaders requested.

What comes next Applicants for items laid over were asked to appear at the next council meeting and to continue working with neighborhood associations to formalize agreements.
