Hearing Officer Kellan Spielman approved a replat that adjusts a common lot line between Tract A of Village Green and Lot 1A of Cosmic Park Subdivision, creating two lots of about 4.75 acres and 11,530 square feet, during the Fairbanks North Star Borough Administrative Hearing on Feb. 20.
The final decision adopted the staff report and findings of fact A through C and approved the replat with six conditions. Spielman added a sixth condition requiring a plat note that links Tract D to the original Planning Commission planned unit development approval on Sept. 6, 1973, under Fairbanks North Star Borough Code Title 49. Spielman read the new condition into the record: “a plat note be added to the plat that Tract D was originally approved under a planned unit development by the Planning Commission on 09/06/1973 under Fairbanks North Star Borough code title 49. All conditions, imposed by this approval are still valid.”
The staff report described the filing as a quick plat: an internal lot-line reconfiguration that does not create more than four lots and does not increase nonconformity under Title 17. Staff (presenting planning staff) noted the replat would resolve setback issues and recommended approval with five conditions and three findings; Spielman’s added plat note raised the total to six conditions. Staff also noted plat note revisions requested by GBA, inclusion of underground crossing language, adjustment of flood zone designation language, and a standard rural services driveway permit note.
Applicants and staff confirmed there is legal access via Nebula Way, Dartmouth Drive, Oak Drive, Maple Drive, Maple Drive, and Hickory Drive, and that the replat is an equal area swap intended to give Village Green more space behind its buildings. No members of the public signed up to testify.
The decision may be appealed in writing to the borough clerk’s office within 10 working days. A final plat must be prepared by a registered land surveyor and submitted to the Community Planning Department within 24 months or preliminary approval becomes void.
