The Fairbanks North Star Borough Board of Equalization voted 5-0 on March 14, 2025, to instruct the board attorney to file a notice of nonparticipation in Superior Court appeal case number 4FA2501055C1.
Board attorney Mr. Gaddy told members the borough has filed an administrative appeal related to the board’s decision in the matter involving First Assembly of God and that the board itself is not a party to the court case. “The board is not a party to the case,” Gaddy said, and he recommended filing the notice so the court knows the board does not intend to appear or file an amicus brief.
Gaddy said the Superior Court will review the record and determine whether the borough’s request to reverse the board’s decision is warranted. He described the appeal as a records-based matter and noted that, in previous similar cases, the board typically has not participated in the appeal.
Board members asked procedural questions; one member said the audio made parts of Gaddy’s explanation difficult to hear. Miss Ferguson moved to instruct the attorney to file the notice, and the motion was seconded (name recorded with variation in the transcript). The clerk called the vote: Ferguson, Shuster, Kaczynski, Foldo and Markwood voted yes. The chair declared the motion passed, 5-0.
With no further business, the Board of Equalization adjourned at 2:07 p.m. on March 14, 2025.
