Linn County holds public hearing on petition to vacate portion of Cummings Ford Road

The Linn County Board of Supervisors on Jan. 21 opened and closed a public hearing on a petition to vacate a portion of Cummings Ford Road after county staff said neighbors and the petitioners supported the request.
The petitioners, represented in public comment by Dustin Hammersland of 618 Main Street South in Center Point, said the family recently purchased parcels north and south of the road and have worked with the secondary roads department on the vacation request. County staff described the vacated area as 84,795 square feet, or about 1.95 acres.
The hearing matters because vacating a county right of way can change property access and maintenance responsibilities. Curtis Logan of the Linn County Secondary Road Department told the board that staff had received no objections and that nearby property owners who had heard about the petition were supportive; he added that some neighbors have asked for a larger portion to be vacated.
Board members said they would not take a final action at the Jan. 21 meeting. The county chair opened the hearing by motion, and the board voted by voice to open it; after receiving comments and hearing that no objections had been filed, the chair moved to close the hearing and the board again approved the motion by voice. County staff said the county engineer is expected to include the vacation request on Wednesday’s agenda for a final decision.
No formal vote to vacate the right of way was recorded at the Jan. 21 meeting. The board’s actions on Jan. 21 were limited to opening and closing the public hearing and receiving public comment from the petitioners and secondary road staff.
The board adjourned the hearing without further action; the petition will be considered again when the county engineer places the item on the following meeting agenda.
