Commissioners authorize road-use indemnity for Tanzanite Energy Storage; direct post-construction inspection

Henderson County Commissioners Court approved a special road-use indemnity agreement and permit with Tanzanite Energy Storage LLC for work on County Roads 3718 and 3720, and commissioners directed county staff to inspect the roads after construction to assess damage and needed repairs.

Commissioner McCam presented the item and told the court the battery storage project involves "a tremendous amount of heavy construction" and said the agreement extends a prior road-use arrangement. "After the post construction, there will be a look at the road, see what damage it caused, what needs to be done to fix the damage," Commissioner McCam said. The court approved the permit and indemnity agreement with authorization for the commissioner and county judge to sign.

County staff confirmed insurance and bonding were in place as required by the agreement and that the document contains the county's established bond and indemnity provisions. The action is an extension of the prior permit the court granted for the site last year.

The court recorded the action as unanimous. Commissioners asked staff to schedule and report back with a post-construction inspection of the two county roads to identify necessary repairs and associated costs. No timetable for the inspection was specified in the transcript; staff follow-up was described as a next step for Precinct 3 road maintenance.
