Judge Stephanie Boyd adjudicated Ruby Casares guilty and sentenced her to five years in prison after the state moved to revoke her deferred-adjudication agreement during a docket call in the 187th District Court.
The judge accepted a stipulation and the state 92s recommended agreement. "The court will find you guilty, revoke, sentence you to 5 years in the prison, credit for any time served," Boyd told Casares in open court. Defense counsel confirmed the agreement and the court entered an affirmative finding of family violence.
The court record shows the state charged a violation of condition number 41 and recommended the five-year sentence as part of a negotiated disposition. Defense counsel told the court the intent was to request credit for time already served; the judge said that credit will be applied to the five-year sentence but that any additional county-jail credit is determined by the jail or the prison system.
