Selectmen table DOT drainage‑easement approval for Route 28 culvert replacement pending town-counsel review

Kayla Woods, a New Hampshire Department of Transportation right‑of‑way agent, asked the Board of Selectmen to sign permanent drainage easements over conservation lands at the Route 28 culvert replacement site near Winnipesaukee Estates.
Woods said the existing 60‑foot corrugated metal pipe has failed and DOT proposes an 8‑by‑6‑foot precast box culvert sized to pass a 100‑year storm. The project requires permanent drainage easements that will overlay existing conservation easements, plus temporary construction easements to provide workspace for installation. DOT representatives said clearing will be limited to scrub brush, re‑loaming of slopes is planned, and tree cutting would occur after Nov. 15 to avoid disturbing migrating bats.
Woods outlined staging and traffic-control plans: alternating one‑lane traffic during construction, with temporary signals and a sequence of work spread over two construction seasons. She said the box culvert will be installed as large, preformed sections.
Selectmen asked for assurances about construction staging, erosion control and legal review of the deed language. Town counsel review had not yet been completed; board members agreed to table the request until counsel examines the drainage‑easement deeds and returns the documents to the board at the next meeting.
A motion to table the easement approval until legal review and to return at the next meeting carried on a voice vote.
