Staff explained the Mineral Wells Chamber Leadership Class 27 and local groups built the dog park at the site formerly owned by Crazy Water Hotel PBC Inc., and the developer has offered to donate the 3.343‑acre parcel and improvements to the city. Multiple memorandum agreements between Friends of the Dog Park, Envision Mineral Wells, and a landscaping contractor were submitted to staff; staff proposed making those agreements exhibits to the city’s conveyance agreement.
City legal counsel and staff raised questions on the record about the effect of state law on donating park land. The staff summary cited a provision in the Texas Local Government Code that requires voter approval to sell property dedicated as a public park, and staff said legal counsel is researching whether leases or donations trigger that election requirement. Staff asked council for direction and said they would bring back a final agreement at the next meeting. A council member and several council speakers praised the facility and the volunteer effort.
No final acceptance or conveyance vote occurred at the March meeting; staff will return the item for council action on April 1.
