The Town of Davie Council approved an ordinance amending Chapter 12 of the land-development code to implement procedures for projects that qualify under the state "Live Local" law. The ordinance requires the usual site-plan review and public participation steps but places the final decision for qualifying projects with the town administrator or a designated administrative public hearing.
Town Attorney Alan Wyenthal and staff told the council the draft ordinance was written to comply with the state statute while preserving public participation. Staff said the ordinance requires projects submitted under the specified state statute to complete the site-plan review and public participation processes; however the final determination will be administrative, not a final council vote.
During deliberations several council members expressed concern about removing council as the final decision-maker for qualifying developments and asked for a legal memorandum and a workshop to clarify the law’s limits and the ordinance’s effects. One council member moved to deny the ordinance but that motion failed for lack of second; another member moved to approve on second reading and the council approved the ordinance.
Supporters on council and staff said the administrative review is required by the state statute and that the ordinance creates a transparent administrative process with public notice and participation. Opponents urged more time to study the statutory language and recommended a council workshop before the new procedure takes effect.
