County attorney strengthens contract language for sheriff’s office building-envelope work; scope unchanged

Dave Curtis, Johnson County facilities director, told supervisors that the county’s proposed Phase 2 professional services agreement with Acxiom Consultants for building-envelope stabilization at 511 South Capitol Street is back before the board after review by the county attorney’s office. Curtis said the county attorney “supercharged” the contract language but that there is no change to scope or schedule.
“There's no difference in the scope. ... It's just the contract that's been supercharged,” Curtis said, adding that Acxiom had already indicated readiness to set a kickoff date despite the review delay. County counsel highlighted several changes staff made to improve county protections, including raising insurance coverage requirements and clarifying ownership or perpetual free use of project documents should the county terminate the contract.
A representative from the County Attorney’s Office said the revisions secure a higher level of insurance, adjust liability allocation so the county retains the deliverables it paid for, and make contract language consistent between phase 1 and phase 2 provisions.
Curtis and counsel said the revised contract could serve as a more robust template for future county agreements. The board did not take a formal vote at the work session; staff said the item will be on the March 13 formal agenda for action.
