Provo council approves annexation, zoning changes and development agreements; airport industrial rezone passes 6-1

The Provo City Council on Jan. 14 approved a package of land-use and zoning measures that city staff said will guide development along several corridors and address long-standing sites on the city's west and northeast sides.
The council approved by unanimous votes ordinances to annex roughly 15.6 acres near 1000 North Lakeview Parkway and to update rules for flag lots and other technical standards. Those items passed with little public opposition and were presented by city planning staff.
Airport-area rezone: The council approved, 6-1, a zone map amendment to change a 25-acre tract near 3450 West Center Street to Provo's airport industrial (AI) zone for a flex industrial campus. Planning staff and the applicant described the project as a multi-building flex industrial/office and warehouse campus that includes open-space amenities and river-adjacent public access. Aaron Ardmore, planning supervisor, said the planning commission recommended approval conditioned on guaranteed river access and amenities.
Developer Eric Jorgensen told the council the project team will "do everything in our power to maintain trees" along the Provo River corridor but noted some trees near trail alignments may not be feasible to preserve. Questions from councilors focused on building height and tree preservation. The applicant estimated interior clear heights of 32 to 36 feet plus parapets of 4 to 6 feet (a top-of-parapet approximate of up to 42 feet in places), and said the buildings would not approach the AI zone maximum of 55 feet. Council member Becky Bogdan cast the lone no vote; the ordinance passed 6-1.
Townhomes in Timpview: The council also approved a zone map amendment from A-1.5 to MDR for a proposed 16-unit for-sale townhome project at approximately 5568 North Canyon Road. The applicant, David Berganji, said the reduced size (from a previously proposed larger project) fits current sewer capacity and neighborhood expectations. Berganji offered proffers including a minimum owner-occupancy percentage; during council discussion he agreed to a minimum 50% owner-occupancy with deed restriction and CC&R language to be recorded to enforce the requirement. Staff and neighbors described the development as consistent with the recently adopted Northeast Neighborhoods plan and said the development agreement will contain language requiring the commitments discussed by the applicant and council. The motion passed 7-0.
Other technical updates: David Day, assistant city engineer, presented yearly text updates to Provo City standards and referenced adoption of 2025 APWA standards; the ordinance adopting those references was approved 7-0.
Why it matters: The approvals shape where and how the city expects industry, housing and public access to the Provo River corridor and selected neighborhoods to develop. Several speakers and councilors emphasized preserving river access and tree buffers while allowing new development. The townhome approval included new contractual language the council is increasingly using to encourage owner-occupied housing.
