Provo council approves sale of small parcel at 3100 W. 240 N., retaining river-access easement

The Provo Municipal Council on Feb. 25 approved a resolution placing a parcel generally located at 3100 West and 240 North on the city's surplus property list and authorizing the mayor to dispose of the property.

Tara Riddle, the city's property administrator, told the council the city acquired the parcel in February 2005 to provide access for public-works maintenance of the Provo River. She said the parcel contains just over 14,000 square feet and that a nearby developer has asked to incorporate the sliver of land into an adjacent subdivision. "The property contains just over 14,000 square feet... The property is going to be sold at appraised value of 36,000," Riddle said, adding that the developer agreed to provide access to Provo City through a dedicated street and an access area at the end of that street so the city can continue river maintenance.

Riddle said the departments with potential interest in the property completed a review and recommended sale provided city access for maintenance is preserved in the subdivision plat. The council opened and closed public comment on the item with no speakers addressing the sale; it then recorded unanimous approval.

Council votes were recorded verbally: Councilor Christiansen, Councilor Garrett, Councilor Hanley, Councilor Hogan, Councilor McKay, Councilor Whipple and Councilor Bogdan all voted yes. The resolution passed 7-0.

Riddle asked the council only to approve placing the parcel on the surplus list and authorize disposal; details of deed restrictions, access easements and the final sale contract were not presented in the public meeting.
