The Civil Justice Subcommittee unanimously (7-0) voted to add amendment 4350 and send House Bill 904 to the full judiciary committee.
The bill, as presented in committee, "would give an administrative judge another option to consider when trying to determine if a person is owed attorney's fees from a contested case hearing involving the ABC," the sponsor told members. The amendment added in committee was recorded as 4350 and was adopted before passage.
Sponsor remarks described the bill as allowing fee awards when a person prevails in an administrative action brought by the Alcoholic Beverage Commission and incurs fees and costs as a result. There were no substantive opposing witnesses recorded in the transcript and no detailed fiscal or implementation analysis discussed during the subcommittee's consideration. The clerk recorded seven ayes and zero nos; HB 904 goes next to full judiciary as amended.
Committee members asked no substantive follow-up questions during the brief discussion, and the measure was advanced on a recorded voice vote.
