Board reports out of closed session on two water-related cases; Tulare Basin Water Storage District appointments confirmed

In closed session the board voted to join a challenge to a new validation action in Sacramento Superior Court and to dismiss certain Fresno County litigation. The board also approved appointments to the Tulare Basin Water Storage District after county elections staff said the district received the same number of candidates as open seats.
At its March 18 meeting the Kings County Board of Supervisors reported out of closed session on two legal matters and approved appointments to the Tulare Basin Water Storage District.
Deputy County Counsel Elizabeth Rodriguez reported that in Sacramento Superior Court case number 25CV000704 (California Department of Water Resources v. all persons interested in the matter) the board adopted a motion to join with Tulare Basin Water Storage District to oppose a new validation action. The motion was made by Chairman Doug Verboone and seconded by Supervisor Joe Neves; the board recorded votes of yes by Verboone, Neves, Thayer, Valle and Robinson.
Rodriguez also reported that in Fresno County Superior Court case number 20CECG01302 (State Water Contractors et al. v. State of California Department of Fish and Wildlife et al.) the board voted to dismiss the 2020 LTO ITP actions with an agreement that all parties will bear their own fees and costs. That motion was made by the chairman and seconded by Supervisor Neves; the vote was recorded as unanimous.
On the consent calendar the board approved appointments to the Tulare Basin Water Storage District. Emily Olivera, elections supervisor for Kings County, told the board that the district published a notice of intent and opened a nomination period; 11 offices were up for election and 11 candidates filed, and under the Elections Code candidates are appointed in lieu of election when the number of candidates equals the number of open seats.
Ending: County counsel and staff provided the closed-session report and said there was nothing further to report; the appointments will be processed according to the Elections Code provision described by county elections staff.
