Deltona commission denies Vineland Reserve Phase 1 final plat after stormwater peer review flags failures

The Deltona City Commission unanimously denied acceptance of the Vineland Reserve Phase 1 final plat on March 18, 2025, citing engineering findings that stormwater infrastructure in earlier phases of the development is not functioning as permitted.
David Hamster of Pegasus Engineering presented a technical memorandum prepared for the city. Hamster told the commission the post‑construction inspection identified deficiencies that must be corrected before vertical construction in Phase 1 proceeds. He said the memo recommends actions that should be completed prior to issuance of building permits.
Commissioner Lully, who moved to deny the plat, framed the motion by referencing the city’s consultant findings: “Based on findings of our engineering consultant, I hereby move to deny resolution number 2025‑24 for the Vineland Reserve Phase 1 final plat.” Commissioner Howington seconded the motion; it passed 7–0.
Commission discussion and public testimony focused on stormwater performance. City staff and the consulting engineer said earlier phases’ dry‑bottom ponds have not functioned as intended during recent storms; the St. John’s River Water Management District placed the developer on notice. Residents told the commission that one dry pond remained full for 138 days after Hurricane Milton and that nearby yards and school properties experienced recurrent flooding.
Planning staff pointed to conditions in the draft resolution that condition permit issuance on completion of required peer‑review corrections and certified compliance with the preliminary plat and engineering approvals. Condition 2 requires completion of a peer review reanalysis and corrective work prior to vertical construction; condition 4 conditions construction permits on certified compliance with the previously approved preliminary plat and related documents.
The applicant was not present for the hearing. Commissioners and several residents urged that corrective work be completed and independently verified before any final plat acceptance or building permits are granted. The city engineer’s memorandum was accepted into the record as evidence.
Outcome and next steps: The denial prevents Phase 1 vertical construction until the developer addresses the stormwater deficiencies identified in Phases 2 and 3 and until the city receives evidence of compliance. Staff indicated they will continue technical coordination with St. John’s River Water Management District and the developer, and the developer may return with corrected engineering and peer‑review documentation for future consideration.
