Senate committee advances consensus technical fix for hospital meal and rest breaks

Substitute House Bill 18 79, a bipartisan, negotiated update to hospital meal and rest break rules, was presented to the Senate Labor & Commerce Committee and described by staff as a technical statutory clarification to accommodate 12-hour hospital shifts.
Representative Brianna Thomas, the prime sponsor, described the bill as a “consensus bill” supported by nurses and hospital employers. Committee staff said the measure would allow a hospital employee and employer to agree in writing to combine certain meal and rest periods or to waive specified breaks during shifts under defined conditions; waivers must be voluntary, revocable, and include a summary of L&I rules and notice about collective-bargaining rights. Waived breaks are not to be counted as missed breaks for reporting and enforcement. Hospitals must include information on waived breaks in quarterly reports to L&I. The bill takes effect Jan. 1, 2026; a partial fiscal note showed a one-time $100,000 cost to L&I from the accident medical aid accounts.
Labor unions and hospitals testified jointly in support. Lindsey Grad of SEIU Healthcare 1199NW said the change “makes sure that the statutory framework matches the actual lived experience in hospitals,” where 12-hour shifts are common. Ashlyn Strong of the Washington State Hospital Association thanked labor partners for negotiating the language and urged committee support.
No opposition testimony was taken at the hearing. The committee reserved action for a later date this week.
