Committee asks staff to draft ordinance to regulate vitamin/CBD storefronts, distances and signage after Lincoln Road concerns
Summary
In response to community concerns about concentrations of vitamin, CBD and THC shops on major corridors including Lincoln Road, the committee asked staff to draft LDR language that would define "vitamin shops," enable separation distances, restrict exterior merchandising and consider prohibition in some CD‑3 districts.

Committee members directed staff to draft an ordinance to regulate vitamin, CBD and related storefronts after commissioners expressed concern over rapid proliferation on Lincoln Road and other pedestrian corridors.
Staff recommendation and scope: Planning staff recommended creating a definition for "vitamin shops" (including nutritional supplements and similar retail), adding a regulatory section in Division 12 of Chapter 142 that would cover primary and accessory configurations, and allowing distance separation requirements between standalone vitamin shops and between vitamin shops and schools. The draft approach would exclude accessory sales of supplements inside grocery or pharmacy chains from strict separation rules but would limit exterior signage and display visibility from the right‑of‑way for accessory uses.
Why it matters: Commissioners and community members said concentrations of such storefronts (and some storefronts with tobacco/vape or similar products) are changing the pedestrian character of high‑profile retail corridors. The committee asked staff to prepare ordinance language and to consider broader state and federal changes to cannabis laws when drafting the local approach.
Next steps: Staff will prepare draft LDR language for committee review and possible referral. The committee left the item in committee for further drafting and analysis.
