Committee asks staff to draft North Beach standards to curb nuisance retail and accessory uses

The Land Use & Sustainability Committee asked city planning staff to draft an ordinance that would expand existing limits on certain retail and accessory uses in North Beach commercial districts to preserve the area’s commercial character.
Vice Mayor Fernandez said the goal is to limit proliferation of nuisance retail uses and accessory commercial activity that staff and commissioners have observed in North Beach. Planning staff described current restrictions that already apply on Normandy Drive, 71st Street and some Target commercial corridors and noted the administration’s proposal would expand those restrictions to additional CD (Commercial District) and RM (residential multifamily) districts in North Beach.
Staff listed uses currently restricted in some North Beach zones — tobacco and vape dealers, packaged liquor stores, check-cashing businesses, tattoo studios and “occult science” establishments — and suggested the committee consider adding an expanded list: souvenir and T‑shirt shops, convenience stores, certain pharmacies, medical cannabis establishments, standalone bars/entertainment uses and vitamin/CBD retailers. Planning staff said the draft ordinance would identify specific geographic boundaries and explain where accessory commercial uses to hotels and apartments could be limited.
Commissioners said they wanted the committee to review a draft ordinance before any commission referral. One commissioner said restrictions should be tailored so they do not unnecessarily block neighborhood economic activity, while others indicated support for targeting uses that have shown up as problematic in North Beach.
Committee direction: staff will draft an ordinance specifying boundaries and the list of restricted accessory and ground-floor uses in targeted North Beach commercial and RM 2/RM 3 districts and return the proposal to the committee for review. Staff suggested the earliest return would be January to allow time for drafting and analysis.
