House committee accepts most 2024 education rule changes, rejects temporary content-standards rule and approves special-education manual

The House Education Committee acted on three rule dockets that together address graduation requirements, content standards, and Idaho's Special Education Manual.

Greg Wilson, chief of staff at the State Department of Education, briefed the committee on docket 08-0203-401 (pending rules) and said the package includes updates to statewide graduation requirements, the special education manual, and content standards reviewed in 2024. He said the Senate accepted most of the pending rules but rejected two social-studies sections and preserved a one-credit speech and communications requirement, while the pending rules would add a digital-literacy credit and update graduation requirements to apply for the class of 2028.

Multiple witnesses spoke. Diane Bevan of the Idaho Technology Council urged the committee to keep communications and add digital literacy as a high-school graduation requirement, arguing that digital skills are essential to Idaho's workforce. Samuel Lehi, representing the Idaho Freedom Foundation and the National Association of Scholars, said he and his organizations are cautiously encouraged that the Senate removed the grade-4 and grade-6–12 U.S. history sections and welcomed the department's plan to reconvene work on social studies standards.

Committee members debated the scope and mechanics of the dockets. Representative Harris asked whether striking two sections from an incorporated-by-reference social-studies document would unintentionally remove other grades; Lauren Smizer, Regulatory and Legislative Affairs Bureau Chief at the Division of Financial Management, explained the Senate's motion specifically targeted grade 4 social-studies and grades 6–12 U.S. history within the incorporated document. Representative Baez moved to accept the pending rule docket in whole; Representative Garner offered a substitute motion to accept the pending docket with two explicit exceptions: exclude fourth-grade social studies and grades 6–12 U.S. history in the Idaho content standards, plus an exception to section 0105.01.D of the pending rule. The committee approved the substitute motion by voice vote.

On docket 08-0203-402, the temporary rule that would have incorporated the revised content standards into temporary rules, staff and the Department asked the committee to reject the temporary rule consistent with the committee's action on the pending docket. Representative Clow moved to reject the temporary rule; the committee approved the rejection by voice vote.

On docket 08-0203-403, the temporary rule incorporating the Idaho Special Education Manual, Greg Wilson and department staff said the U.S. Office of Special Education Programs required updates to Idaho's eligibility criteria to comply with the federal Individuals with Disabilities Education Act. The department said promulgation of a temporary rule was necessary to ensure schools operated under a compliant manual for the current school year and to bridge to the pending rule that would take effect July 1. Representative Garner moved to accept the temporary special-education docket; the committee approved it by voice vote. Staff clarified that approving the temporary rule will bridge operations from sine die to July 1 when the pending rules take effect, and that the pending rule corresponding to that manual will replace the temporary rule on July 1.
