ZBA grants frontage variance for Clary property after boundary line adjustment

The Alton Town Zoning Board of Adjustment on Nov. 7 unanimously granted a variance to Jay and Julie Clary for a property on Bear Pond Road, permitting frontage under the 200‑foot requirement in the rural zone after a recent boundary line adjustment.
Application Z24‑46 sought relief from Article 400 §4.52(b). The Clarys told the board the change was needed because a prior boundary adjustment moved the leachfield and created a technical new lot description; the applicants said they have agreed to a small acreage transfer to the adjoining DeRosa property to remedy the location of the septic system.
Julie Clary addressed the board, saying she and her husband “absolutely” agree to transfer the 0.14‑acre portion to Mr. DeRosa to resolve the septic placement. Board members discussed the lot’s history — that many lots in the area predate zoning — and noted that nothing on the lot is changing other than the legal description. No members of the public spoke for or against the application.
Board members went through the variance worksheet and found the request met the public‑interest, spirit‑of‑ordinance, substantial‑justice, diminution‑of‑value and unnecessary‑hardship tests. A motion to grant Z24‑46 passed by voice vote with board members responding “Aye.”
The board recorded that the frontage has been 50 feet on record since the lot’s creation in about 1969 and that the practical effect of the decision is to legalize existing conditions and to allow the septic to remain on the parcel it serves.
