Council authorizes sewer agreements, legal representation and Cedar Street IGA amendment after executive session

Sewer service agreements: Council authorized the county administrator to execute a sewer service agreement between Dorchester County and Stream Realty Acquisition LLC (TMS 1100000022). Earlier in committee, the Water & Sewer Committee had also approved a separate request for new sewer service by Lenore Carolina’s LLC for a mixed‑use development in the town of Somerville (TMS numbers as submitted in the packet). County staff indicated the Lenore Carolina service request was an additional phase and that the property does not abut sensitive county parcel purchases.
Legal representation: Council authorized the county administrator to execute a representation agreement with UPF Litigators, LLC and Murphy Cranford Meehan to pursue possible claims as described in the representation agreement. The motion passed unanimously.
Cedar Street extension IGA amendment: Council authorized an amendment to the intergovernmental agreement (IGA) for the Cedar Street extension with the Town of Somerville to allow Berkeley County to manage that project and to provide an additional $115,000 to complete right‑of‑way acquisition on five parcels located in Dorchester County. Council authorized the county administrator to execute the amendment; the motion passed unanimously.
All three votes were taken after council returned from executive session; council reported discussing the announced contractual matters in closed session and taking no other actions in executive session.
Why it matters: the sewer agreements enable new utility connections for development in Somerville; the representation agreement engages outside counsel for possible litigation or claims; and the IGA amendment delegates project management for the Cedar Street extension while providing $115,000 for right‑of‑way acquisition in Dorchester County.
Next steps: county staff will execute the signed agreements and proceed with right‑of‑way acquisitions and any subsequent project management coordination with Berkeley County and the town of Somerville. Council asked staff to proceed under the authorized motions.
