The Evanston Land Use Commission on Aug. 13 voted to continue the plan-development public hearing for 605 Davis (case 25PLND-0019) to Aug. 27 after staff and the city attorney determined that several property owners within the notice boundary should have been granted continuances for the July 23 hearing.
The commission’s action followed staff review and legal research finding an inconsistency between the commission’s rules and the zoning ordinance about which parties are automatically granted continuances. The commission chair apologized for the confusion and said staff had notified additional property owners on Monday that they would be permitted to speak at the continued hearing.
At the meeting, Chair Lindwall said property owners within the notice boundary are entitled to one continuance by written request without stating a reason, while non‑property‑owner residents and businesses must give a written reason for a continuance and the commission may vote on those requests. Staff and the law department concluded that six property owners who lacked stated reasons should nevertheless have been granted continuances because they were within the notice area.
Because at least one of the newly eligible speakers asked for extra time to prepare, staff recommended continuing the entire hearing rather than hear a subset of speakers on Aug. 13. The continuance preserves the record and allows all granted speakers to present at the same session.
Staff outlined the procedure for the continued hearing. Individuals granted continuances will have up to five minutes each to present testimony and evidence; an expert witness for a granted speaker may be allowed an additional five minutes. After public testimony from granted parties, the applicant will have up to 20 minutes for rebuttal or closing remarks. The record will then be closed and the commission will deliberate; commissioners who missed the July 23 meeting were asked to watch the recording and review submitted materials before deliberations.
A motion to continue the case to Aug. 27 passed on roll call with five votes in favor and none opposed. The commission asked staff to accept written testimony from any granted speaker who cannot attend the continued hearing and to include the previously requested corrections to the July 23 minutes on the next agenda.
The continuation applies only to the public hearing for 605 Davis; no substantive rulings were made at the Aug. 13 meeting.
Less critical details: staff reminded the public that contact with commissioners on pending cases is inappropriate and that written materials will be accepted and distributed as part of the commission packet for the Aug. 27 hearing.
