Saint Ann board revokes Matrian Inc. special-use permit but delays enforcement to Aug. 31

The Board of Aldermen of the City of Saint Ann voted to revoke special-use permit 2018-02 held by Matrian Inc., doing business as Masters Transportation, for repeated parking violations but stayed enforcement of that revocation until Aug. 31, 2025.

The vote followed a formal evidentiary hearing at which the city presented documentary evidence, photographs and sworn testimony it said showed shuttle and rental vehicles parked outside the permit’s designated area at 11140 Old Saint Charles Rock Road. Kyle Cronin, speaking for the city, said the evidence would show the permittee “has violated the conditions of its special use permit 2018-02” and “has not made or taken any substantial actions to correct those violations.”

The city’s building commissioner, Robert John Vogel, testified that the approved site plan and permit required shuttle vehicles to park behind the building in a specifically identified area. Code enforcement officer Jim Fossil described on-the-ground inspections and photographs taken in April and May 2025 that he said showed multiple vehicles registered to Matrian parked outside the permitted rectangle. Fossil testified he mailed a notice of violation on Oct. 17, 2024, and continued to observe noncompliance thereafter.

Representatives of Matrian attended and said the company is searching for an alternative site and asked for time to relocate. Kent Jennings, branch manager at the local Matrian/ Masters Transportation location, told the board the business regularly vacuums and cleans returned vehicles and that some vehicles are momentarily pulled forward while being prepared for the next rental. He also said the company is seeking a new, specialized location and hoped to relocate within months.

After discussion the board adopted a motion to revoke the permit for violations “pertaining to the parking of shuttle vehicles,” but to stay the execution of that revocation until Aug. 31, 2025. The motion passed on a roll-call vote: Singer (aye); Maria (aye); Thomas (aye); Sparks (yes); Murphy (yes); Cronin (yes); Shy (yes). The board directed code enforcement to continue monitoring compliance during the stay and advised staff to document any further violations.

The mayor framed the hearing as an administrative evidentiary process under the city code. The board’s opening instructions cited Chapter 400 of the Saint Ann Municipal Code and the statutory provision the city would rely on if revocation were warranted. City counsel offered a certified-mail return receipt and other materials as exhibits documenting notice to Matrian’s corporate address and to the property.

The board did not immediately impose additional conditions beyond the stay. City staff noted that if Matrian continues to violate the permit during the stay, the previously adopted revocation would be effective upon discovery of those violations.

The action resolves a months‑long enforcement matter that began with a city notice in October 2024 and culminated in the formal hearing. The board indicated it would expect either relocation of the vehicles to the approved area, relocation of the business offsite, or full compliance with the permit’s parking restrictions before Aug. 31, 2025.
