The Hastings City Council authorized the mayor to execute documents to obtain and maintain a letter of credit for $1,690,304.25 from 5 Points Bank to satisfy the U.S. Environmental Protection Agency’s annual performance-guarantee requirement tied to a local groundwater contamination site. City staff explained the transaction is an annual EPA requirement for municipalities with active groundwater contamination sites and that the bank letter of credit would be collateralized by a certificate of deposit in the same amount. Staff said the specific figure is an EPA-calculated amount based on site characteristics and regulatory formulas; staff also told council the city has not previously needed to draw on the funds and that the amount had decreased in recent years from near $3 million after the EPA revised its calculations. Councilors asked whether the city shops the fee and bank selection; staff said the city has used 5 Points Bank for the past several years and noted a substantial fee reduction compared with an earlier bank. The city will proceed with the letter-of-credit execution and collateralization process per EPA requirements and banking terms.
