Carl, the district’s contract attorney, told the board staff prepared a resolution that would declare a recorded petition seeking to eliminate covenants on Tract 310 to be spurious. Counsel said the petition contained numerous invalid signatures—many did not match property owner records and signatures were not notarized—and that one individual signed dozens of entries.
Carl said the office will prepare a staff report and present the resolution to the board on Monday. “This is where there was a petition, that was executed and recorded, but, there were many there are many signatures that didn't match up with the property owners' names, and none of those signatures were notarized,” he said. Board members discussed the quantity of problematic signatures; one director said an initial visual count suggested about 170 signatures, while another corrected that to 59 signatures attributable to one person and one other signature identified.
Staff did not report a formal board vote in the work session; legal counsel said the resolution will be provided to the board and presented for action at the Monday meeting.
