Board clears lot-line issue, grants variance for 803 Fairview Drive and directs preliminary plat

The City of Washington Board of Adjustment on June 9 granted a lot-size variance for 803 Fairview Drive to allow a 9,756-square-foot lot where the city code minimum is 10,000 square feet, and directed the city zoning administrator to proceed with a preliminary plat to resolve an overlapping boundary with 6 Scenic Drive.
Staff explained that the two parcels overlap and that correcting the overlap using an existing fence line would reduce 803 Fairview Drive to 9,756 square feet; the property owner cited the need to clear the title before selling. Mark Frankenberg, representing the plats and parties, described the issue as a long-standing survey overlap dating to surveys in the mid-1960s and 1970s and said multiple prior surveys documented the error but it had not been fixed.
"This all came about in the mid sixties when John Cochran did the survey for Kochs," Frankenberg said. He added that the house was built in the 1950s and that earlier surveys "found the overlap" and "nobody fixed it." Frankenberg said the present platting and a preliminary plat are intended to clean up the boundary so the owner can proceed with a sale.
The board read a resolution that finds the property within the city limits in an R-1A single-family residential zoning district and cites city code section 400.06(F)(4) requiring a 10,000-square-foot minimum. The resolution grants the variance to 9,756 square feet and directs the city zoning administrator to proceed with the preliminary plat request. The roll call recorded Kevin Creedy as yes, Gwen Montel as yes, Mark Scornia as yes and Samantha Wacker as yes; Jason Pelin was recorded as not voting/present in the roll call at the resolution reading. The action outcome was recorded as approved.
The variance and platting direction are administrative steps to correct historical survey errors and enable the property owner to complete a sale; subsequent platting and recording are required to finalize the boundary correction.
