Council approves Harbor Lights development agreement after edits; member recuses

Depoe Bay councilors on Aug. 19 approved a development agreement with Harbor Lights (applicant Mark Lisek) that clarifies which public improvements must be completed before certificates of occupancy are issued.
City staff said the agreement was revised after planning commission review to add language that more clearly specifies the improvements required prior to occupancy. The agreement also allows limited occupancy sequencing for certain lots (lots 18–24 were discussed as a narrow exception in the draft language) provided fronting improvements for those lots are complete.
The mayor will sign the agreement as the city’s official action. One council member recused from the matter because of a disclosed financial interest in nearby lots; the recusal was noted on the record before the vote. The council did not transcribe a roll‑call vote in the public record excerpt; the motion to approve carried by voice vote.
City staff said larger plan sets and site drawings are available in the planning office and that staff will provide more legible materials to the council when needed as the project proceeds through site‑plan review and permitting.
