Commission approves most waivers for existing used-car lot on Boulder Highway but denies landscaping waiver

Architect Dennis Rusk, representing the applicant, described the site as an existing used-car dealership that has been in operation since the 1990s and said his team sought waivers to retain existing fencing, security measures and site conditions while regularizing entitlements so business licenses could be issued. The application (WS25-01192) covered a 0.6-acre parcel in a CG (Commercial General) zone within Sunrise Manor. Staff and the Sunrise Manor Town Board both recommended denial; the applicant argued the fencing and other nonstandard conditions are necessary for security and have existed for decades.
Commissioner discussion centered on whether to require landscaping along the frontage where the area outside the gate is currently paved. Commissioner Kirk asked whether the landscaping area is outside the secured lot; the applicant confirmed it is paved. Some commissioners expressed willingness to allow the existing fencing to remain for security reasons but said landscaping should be required for older parcels that have gone unmodified for decades. The commission voted to approve waivers 2, 3 and 4 and to deny waiver 1 (the request to eliminate street landscaping). The applicant retains the right to appeal under Title 30.
