Commissioners approve Toll Brothers subdivision after adding Raven Avenue width condition and asking developer to work with neighbor

Commissioners approved a multi-item application from Toll Brothers to rezone and subdivide a 15-acre parcel in Enterprise after adding a condition to secure a 48-foot Raven Avenue right-of-way and asking the developer to work with an adjacent homeowner on site accommodations.
Lucy Stewart, representing Toll Brothers, presented the project that includes a plan amendment, zone change, vacations, waivers and a tentative map for 115 single-family lots on 15 acres. The parcel falls from Pebble Road down to Raven Avenue and staff supported several waivers while recommending denial of others. Stewart said the project previously received approvals under an earlier nonconforming zone change and explained reasons for increased retaining walls and a single lot that does not meet a 7,500-square-foot buildable area due to topography.
Neighbor David White, who said he has lived at his property for 25 years, said Toll Brothers representatives had been cooperative and "promised to build a fence or a wall from there to my house to kind of enclose my property" and had committed to address construction-mud and trash impacts. Mr. White told the commission that the developer had been responsive in his conversations with them.
Commissioner Christian Jones moved to modify conditions related to right-of-way dedications and to add Raven Avenue as a 48-foot right-of-way; he summarized the change on the record with dimensions for back-of-curb dedications for Pebble and Grand Canyon and a 24.5-foot back-of-curb for Raven to ensure the 48-foot standard. Jones also asked staff to record that Toll Brothers would continue to work with Mr. White on accommodations for his property; county staff noted current Title 30 standards prohibit front-yard walls over 3 feet without modification, so any wall would have to comply with existing code unless changed in the future. Jones then moved for approval of items 31 through 35 with the additional commitments and modifications; the motion passed.
The commission did not adopt any immediate code changes regarding front-yard walls but discussed adding the matter to a future discussion item. The approvals permit the subdivision to proceed to engineering and final map work, subject to conditions and the revised right-of-way requirements.
