Council authorizes building permit for 54 Colonial Road with drainage and liability conditions

Details of approval: The planning board reviewed the permit on Aug. 5, 2025, and recommended approval provided the Department of Public Works reviews and approves a drainage plan. The motion before council included three conditions: 1) a drainage plan must be submitted to, reviewed and approved by the Department of Public Works prior to issuance of the permit; 2) the property owner must sign an acknowledgment of the city's limited responsibility and liability for the private road and record it at the Belknap County Registry of Deeds; and 3) the city manager was authorized to sign the notice of limits of responsibility and liability on the city's behalf.
Council discussion focused on long-term implications for private roads and whether future councils could be left with costs to bring a private road up to city standards. City Manager Kirk Biotti said the city now does a better job documenting whether roads are public or private when new development occurs and that new roads are being built to city standards when a developer indicates intent to dedicate the road in the future. "We've been doing a much better job at identifying, and documenting what the expectation of that road is for the 40 years down the line," Biotti said.
The motion to authorize the permit was made by Councilor Fowles and seconded by Councilor Cheney; it passed 6-0.
Ending: Councilors said the conditions are standard for private-road situations and intended to ensure adequate drainage and clarify the city's limited future obligations before a building permit issues.
