The Clark County Planning Commission on March 5 held a waiver request for a rear setback reduction tied to a proposed detached accessory dwelling unit (ADU) in Sunrise Manor, giving the applicant 30 days to revise plans and return.

The applicant’s agent, Joey DeBlanco, said the applicant planned to build the ADU first and later construct the primary residence; he said the county no longer accepts filing a secondary structure ahead of the primary. The commission noted that the required rear setback for a primary residence is 30 feet but that detached accessory structures can have a 10‑foot rear setback. Commissioners asked the applicant to either revise the plan to meet the 30‑foot primary‑residence setback or to present a different schedule showing that the ADU will remain an accessory structure.

A neighbor, Al Rojas, spoke in favor of the proposal from a design/compatibility perspective but was concerned more broadly about large‑scale apartment development nearby. At the meeting, the commission’s chair said the applicant could return in 30 days with revised plans; the motion to hold the item passed and the item was scheduled for the Planning Commission meeting on Sept. 2, 2025, at 7 p.m.

The commission treated the hearing as a hold (continuance) rather than final action, so no formal approval or denial occurred. Commissioners indicated they were concerned that if the structure were intended to be a primary residence it must meet the larger setback; the applicant requested the continuance to provide updated plans.
