On June 17 the Gautier City Council approved a 9-foot variance for a secondary front-yard setback to permit installation of a 30-by-60 metal garage at 5917 Old Spanish Trail, after staff confirmed application fees had been paid and departments had cleared review.
Planning Director Scott Anderson told the council the applicant sought the variance because the lot is a corner lot and the garage would lie within the secondary front yard; the unified code requires a 25-foot setback and the applicant requested a 9-foot variance. Anderson said the application fee was paid on May 5 and that departmental review was complete.
During the meeting Councilman College and others questioned whether the poured slab was in the primary or secondary front yard and whether work had already started without a permit. Anderson indicated the slab had been poured and that the contractor had claimed to the owner that a permit had been obtained; staff had stopped work. Council members recorded that the slab had been poured without a permit and that the contractor had been directed to stop work.
Councilman Anderson moved approval and Councilman College seconded; council voted in favor and the motion carried. Staff noted that because work had begun, building-code and permit reviews remain necessary and the owner may face additional administrative steps for the unpermitted work. The council did not specify any penalty in the meeting minutes for the unpermitted slab beyond stopping work and proceeding with variance and permitting steps.
