The Topeka City Council on Aug. 19 approved an amendment to a planned unit development and zoning at 4100 Southwest Fortieth Street to allow continued operation and expansion of a lawn-and-garden center that occupies the site.
Dan Warner, planning division director, said the PUD amendment would allow additional storage of landscape materials, lawn and garden equipment and related contractor services on approximately 12.6 acres at the south corner of Southwest Fortieth and Gage Boulevard. The change would enable continuation of the existing business and an expansion of commercial C-4 uses on the property, Warner said.
Warner told the council the applicant held a neighborhood information meeting, the Planning Commission recommended approval and staff supported the amendment. Councilman Dobler disclosed he had spoken with the owner, but said he could remain impartial. The council voted to approve the Planning Commission recommendation; the clerk recorded nine affirmative votes and the motion carried.
Warner said the amendment is connected to the annexation earlier in the meeting for adjacent property and will permit the owner to build additional storage and related contractor services subject to standard site plan and permitting reviews.
