Council vacates two sidewalk easements between Canyon Creek Forest and Wheatley Point West at property owners’ request

The Lenexa City Council passed an ordinance vacating two sidewalk easements that cross Lots 51 and 52 of Canyon Creek Forest and a tract in the adjacent Wheatley Point West subdivision.
Stephanie Sullivan of the Community Development Department explained that the original sidewalk easement in Canyon Creek Forest had been platted across private property (Lots 51 and 52) rather than within an HOA tract. When Wheatley Point West was platted later, staff opted to place its sidewalk easement within an HOA tract, which is the city’s typical practice. Prospective buyers of Lots 51 and 52 asked to vacate the easement because they were concerned about having a public sidewalk easement across their private property. Sullivan told the council the application met the city’s four criteria for an easement vacation and that city staff had contacted utilities with no objections.
Councilmember Arroyo asked about the original development dates; Sullivan said Canyon Creek Forest was rezoned in 2020, first platted in 2021 and a second plat approved in 2024, and that the subdivision remains under development. A councilmember commented that while vacating the easement is consistent with current practice, it was unfortunate for residents on the cul-de-sac who now must walk a longer route to reach Clare Road.
Councilmember Mark moved to pass the ordinance vacating the sidewalk easements; Councilmember Bill seconded. The motion passed by voice vote on the record. The transcript records staff recommendation and the ordinance passage; no utilities or members of the public spoke against the request during the public hearing.
