The Planning and Zoning Commission approved a group of routine land‑use items during the Sept. 3 meeting, including minor replats, lot splits and utility easement vacations intended to clear title issues and enable proposed development.
Ms. Johnson, a planning staff member, presented several items that were taken together: a replat of Lot D in Summers First Subdivision at 2313 N. Washington Street to divide one lot into seven for sale or rent (the reduced side‑yard setback on one resulting parcel requires a variance before the Board of Adjustments); a replat to split one parcel out of the Heartland West edition condominium association at 3005 Heartland Drive to correct a title issue; and a combined replat and vacation at 2526 Demers Avenue to remove a lot line and vacate two parallel 10‑foot utility easements so a proposed storage development could extend across both original parcels.
Ms. Johnson told commissioners the Demers vacation includes a condition to record a private drainage easement where a private storm sewer line will remain in place, and to add a 15‑foot easement on the south side of the combined lot. Commissioner Budke asked whether public utilities occupied the easement; Ms. Johnson replied that only a private storm sewer was present and no public utilities were within the easement.
Each replat item was opened for public hearing; no members of the public appeared to speak against the proposals. Commissioners moved and seconded approval of the plats and the Demers vacation; all passed unanimously on voice votes.
Commission staff said the Heartland split was needed because an earlier administrative lot combination had not been recorded in county title records, leaving a gap that the replat will correct. Staff also noted a pending Board of Adjustments variance hearing for the Summers First lot with a 13.1‑foot side‑yard where 15 feet is required. Commissioners approved the items with staff recommendations and closed the hearings.
