The Planning Commission on Aug. 27 approved a conditional use permit for a detached accessory garage at 166 East Brook Avenue that exceeds the typical 8% accessory‑structure lot coverage limit and the 15‑foot midpoint height limit for accessory buildings.
The action matters because the permit relaxes two numeric standards used to control accessory structure size in the R17 residential district while imposing conditions intended to limit visual impact and ensure code compliance.
City planner Andrew Agard told commissioners the property is a 0.27‑acre single‑family lot south of Brook Avenue and east of Nelson Avenue. The applicant proposed a structure with a midpoint roof height of about 20.5 to 21 feet and estimated that detached accessory coverage would rise from the 8% allowance to roughly 10.3%. Agard said the ordinance gives the Planning Commission authority to permit increased accessory coverage and height where the commission finds the structure will not be an eyesore, will not exceed the main dwelling's height, and fits the neighborhood character.
The applicant, Francis McClure, and a representative (identified in the record as Mr. Krippner) described exterior materials and neighborhood context; McClure said the house is largely brick and that the proposed garage exterior would use a product from Trulog (Colorado). Agard told the commission he received no public comments from the required noticing radius.
Staff recommended approval with three conditions: comply with building‑permit and fire‑department requirements; limit the accessory structure to the size shown on the submitted site plan; and cap the height at 21 feet as measured to the midpoint of the roof pitch. Agard also noted any future accessory structures would require separate conditional use permit approval because the property would have reached its accessory coverage allotment.
Commissioner Hamilton moved to approve the conditional use permit (application 2025072) based on the staff findings and conditions dated Aug. 20, 2025; Commissioner Jensen seconded. The roll call vote was 7‑0 in favor.
The approval allows the applicant to proceed with the proposed garage subject to standard building and fire permits and the size/height limitations adopted by the commission. Any additional accessory buildings on the lot would require a new conditional use permit.
