Council tables decision on ROV/ATV ordinance after members cite enforcement challenges

The Pecos City Council on Aug. 28 voted to table further action on an ordinance related to recreational off-road vehicles and utility task vehicles (ROVs/UTVs), giving staff and council time to gather enforcement data and explore options such as a designated off-road facility.
Council members expressed concern about safety and enforcement after hearing resident accounts of unlicensed juveniles operating ROVs on neighborhood streets and citations issued by police. The council adopted an ordinance in 2023 permitting limited operation under conditions but members said enforcement resources have been strained and compliance inconsistent.
Police reported 12 citations written between the ordinance's adoption and July 2024 for violations such as unsafe operation and juvenile drivers. The police chief told council the department—s main enforcement priority is to keep ROVs off major roadways (service roads, Highway 17, Business 20, Highway 285); officers avoid high-speed vehicle pursuits because of safety risks.
Councilman Arona moved and Councilman Graham seconded a motion to table the item until the council—s first meeting in December and to use the intervening months to analyze citation data and consider possible alternatives, including creating a local off-road track. The motion carried. Some council members said they remain concerned that continued widespread noncompliance could lead to a serious injury or fatality if not addressed.
No ordinance was rescinded or adopted at the meeting; the item was deferred for more study and staff reporting.
