Board approves independent-study physical-education policy after public concerns about students skipping PE

The Carson City School District Board of Trustees approved a second-reading revision to CCSD policy 05/39 (independent study in physical education) on Aug. 12 after a presentation by district staff, public comment from district physical-education professionals and a board vote that included two recorded opposing votes.
Why it matters: The change implements Nevada Administrative Code guidance allowing students to receive exemptions from in-school physical education when they complete verified outside activities. Trustees and community members debated verification, academic tradeoffs and whether students might miss required instruction that supports the district’s learning standards.
District presenter Richard Bringhurst described changes to align policy language with the Nevada Administrative Code and to incorporate guidance from the Nevada Department of Education (NDE). He told trustees that some activities (for example, ROTC and marching band) are already eligible under NAC language and may include hours during the school day; other listed competitive or club activities would require 120 documented hours outside the school day to qualify for exemption. Bringhurst said he added clarifying wording to mirror NAC language and included NDE guidance and a frequently asked questions document in the board packet.
Trustee discussion centered on verification and academic implications. Trustee questions asked how a principal would verify 120 outside hours; Bringhurst said principals would use an existing district procedure to log hours, and that the frequently asked questions from NDE states verification “may include documentation such as a signed log of hours from a coach, instructor, or club leader confirming participation, a statement from a coach, instructor, or club leader confirming participation.” Bringhurst said the district’s principal Karstens will adapt a prior logging procedure used for correspondence-based PE credit to fit the new requirements.
Public comment included two speakers. Steve Dilley, department head of physical education and health at Carson High School, told the board the department “fully support[s] allowing to waive 1 year of PE” but warned the policy “opens Pandora’s box” because, as written, a student could conceivably avoid taking PE in high school entirely. Linda Herzl, a retired district physical-education specialist, said secondary standards exist and expressed concern that district middle- and high-school instruction may not meet those standards if students skip in-school PE; she suggested requiring at least one credit at middle school as a possible solution.
Bringhurst and other trustees noted the NAC language and the NDE guidance differ in wording — the NAC uses “shall exempt” while the NDE guidance packet uses “may exempt” — and the district must follow the NAC. Trustees discussed that exemptions are designed to recognize students already physically active (for instance, varsity athletes) while allowing students flexibility to pursue academic coursework. Several trustees asked staff to place verification procedures and timelines in district regulations rather than policy language.
Trustee Roberts moved to approve the revised date for policy 05/39; Trustee Walker seconded. The board took public comment and then voted to adopt the policy. The meeting record shows the motion passed with a majority (reported in the meeting as four in favor, two opposed). The board directed staff to develop administrative regulations for verification and documentation procedures.
