The Watertown Board of Adjustment on June 26 granted a variance to allow replacement of an existing front porch on a duplex located at the properties described in the hearing (addresses noted as 212 Seventh Avenue Northeast and 621 Third Street Northeast). Planning staff told the board the structure is a legal nonconforming building and that the porch is within the front-yard setback.
Planning staff member Brandy explained why the item required a variance: the property predates current zoning and the proposed porch replacement includes structural and porch elements that go beyond a simple stoop, so the replacement constitutes an encroachment that cannot be approved administratively. "This is really, the existing structure... and this is... why it's before you for a variance request for a 0 foot step back," Brandy said.
Applicant representative Tony Neland told the board he represents the buyers, Bob and Brenda Becker, under a purchase agreement and that the seller, Alan Burns, had passed away. "Set to close July 7. And like I said, we're just trying to repair what's there," Neland said.
Board members discussed whether the replacement would enlarge the structure; staff and the applicant said the work is an exact replacement and that the proposal is the least-restrictive alternative because the porch and awning predate zoning. The board moved to approve the variance; a roll call recorded unanimous approval.
The meeting record shows the variance was approved as a relief for a legal nonconforming structure. No conditions beyond normal permit requirements were recorded during the hearing; the applicant will proceed with replacement as described and complete any required building-permit work.
