The Wasilla City Council introduced Ordinance Serial Number 2522, an amendment to the official zoning map to change the zoning district from rural residential to commercial for Lots 1–14 of the Coring Subdivision (public hearing scheduled for Aug. 11). Council member Graham raised concerns that a Planning Commission member had signaled interest in requesting reconsideration of the commission’s vote on the rezone and asked whether the city attorney had provided guidance on whether the Planning Commission can reconsider its decision.
City Attorney Holy Wells told the council that rezone decisions are legislative in nature and the code is silent on a formal reconsideration process for planning commission legislative recommendations. “When we look at rezone, we're looking at a legislative process. ... the code tells us exactly what that process looks like. There it's silent on reconsideration,” Wells said. She said that because rezones are legislative rather than quasi‑judicial, the usual reconsideration procedures for hearings officers do not apply and that starting a formal reconsideration mid‑process could be confusing for the public; if the commission wanted a reconsideration mechanism, staff could propose a resolution to council proposing an ordinance to do so.
Council discussed scheduling and the potential that the planning commission could seek reconsideration after the next commission meeting. The council proceeded to introduce the ordinance with public hearing scheduled for Aug. 11, noting the possibility of postponement depending on the planning commission’s follow‑up.
