The Jefferson County Board of Adjustment on June 18 approved legalization of an existing reduced front setback for a primary dwelling at 10097 Crestview Drive in Morrison but denied the applicant’s request to allow an accessory shed with a zero‑foot side setback.
Planner Jamie Harding told the board the parcel is in the Mountain Residential 2 zone and the homeowner sought two forms of relief: (1) legalization of a front setback of 25.6 feet where 30 feet is required for the primary structure, and (2) an allowance to place a replacement shed at 0 feet from the side property line where 15 feet is required. Staff found the existing front setback met the legalization criteria and recommended approval. For the shed, staff said a flat area existed within the required 15‑foot setback and concluded the applicant had not established an exceptional practical difficulty for a zero‑foot allowance; staff recommended denial of the zero‑foot request.
The applicants told the board they needed vehicle maneuvering space to repair and work on vehicles and that the current shed location was constrained by an existing maintenance easement. Harding explained the existing shed encroached into a maintenance easement and that vacating the easement was not feasible because a neighbor’s lender would not allow it. The replacement shed, the applicant said, was intended to provide usable workspace.
The board approved legalization of the 25.6‑foot front setback by motion, and subsequently considered the allowance for a 0‑foot shed setback. After deliberation several board members expressed concern that the applicant had not demonstrated a hardship that made the requested zero‑foot location necessary. A motion to approve the zero‑foot allowance failed on roll call.
The board approved the legalization portion of the application; staff will advise the applicant about alternatives for locating a shed in compliance with setbacks or pursuing administrative relief where applicable.
