County gate proposal for private Luma Vista road raises safety, liability questions at Scappoose council

Councilors on July 21 discussed a proposal from the Luma Vista development to place a gate on a private road that provides vehicle access near a city park. Developers asked that the gate be closed for 30 minutes to two hours later than park hours in some seasons; the park itself would remain open and pedestrian access would not be blocked.

City Manager Ben Mergener said the proposal is primarily a county decision because the road is under county jurisdiction; the developers have proposed an agreement that would include indemnity and insurance provisions and a homeowners-association arrangement for maintenance. Mergener said the county commission would make the final decision on whether to accept a gated arrangement for the road.

Council concerns: Councilors asked whether the fire district would approve a gate because emergency access could be affected. Councilors also asked whether the county or developer would carry insurance and indemnify the city for delays in emergency response if the gate closed. Chief Pritchard (remarks summarized) told the council firefighters were concerned about any delay to emergency access.

Staff position and next steps: Mergener said discussions continue, and he recommended tabling negotiations until the fire district makes a formal determination. He said the county could still override the fire district’s recommendation, and that staff would seek legal input on indemnity and liability if the proposal proceeds. Several councilors said they prefer to await the fire district’s decision before advancing any draft agreement.
