The Butler County Commission approved payments for the remaining right-of-way acquisitions tied to the Cutler/Butler Road project and heard staff describe a late property transfer that complicated one settlement.
Curtis Mader, director of public works, told commissioners he had four final right-of-way purchases to present — three temporary easements and one permanent acquisition with temporary easement and damage claims — related to the Butler Road project. He described one parcel where the property was signed for condemnation and sold three days after the owner signed, creating uncertainty because the new owner had not yet closed the earlier transaction. Mader said he has spoken with the new owner and “he's gonna work with us” and that the county will proceed but still needs to confirm the legal details. Mader also noted trees, irrigation and fencing increased damages on one parcel.
Commissioner Wazek moved to approve the homeowners' payments for the Cutler Road project; Commissioner Jackson seconded the motion. The commission voted 4-0 to approve the payments.
Mader said that engineering and PS&E plans are in motion, environmental review items remain with the Kansas Department of Commerce, and staff is setting a court date for condemnation matters before final distribution. He added that a culvert has been installed on the project and crews are continuing work; residents who spoke with staff expressed appreciation for progress.
The action at the meeting was approval of payment for the listed easements and temporary damages; no new condemnation orders or policy changes were made at the session.
