Greeley updates water‑court docket and authorizes opposition to Ogilvy application

Morgan Efren, water resource administrator, provided the triannual update for January–April 2025: Greeley has entered three statements of opposition so far in the period and is currently an opposer in 22 cases, with 25 active cases total in 2025. Morgan summarized several pending matters including a change‑of‑supply and storage application to change 23 shares to municipal use (11 active oppositions, 13 stipulations reached) and a co‑applicant river‑flows augmentation plan (21CW3056) with 20 statements of opposition; trial in that case is calendared for Oct. 20, 2025 and a rebuttal expert disclosure is due in July.
Dan Buer of the City Attorney’s Office recommended filing a statement of opposition in case number 25CW3036, an application by Ogilvy Irrigating and Land Company and Ogilvy Augmentation Company concerning a conditional surface right decreed in 1987 that diverts from a stretch of the Poudre River. Dan said staff recommended opposition to better understand the applicant’s plans and because the “this is a pretty important stretch of the Poudre for the city.”
The board voted to authorize filing the statement of opposition and to have staff and legal counsel seek resolution of issues in the case consistent with Water and Sewer Board Resolution No. 3 (2015). Chairman Evans called for the motion, a second was recorded, and the board approved the action by voice vote.
