The City of Clayton Board of Zoning Appeals on Aug. 5 approved a conditional-use certificate allowing a Type A child care—Sky’s the Limit Child Care LLC—to operate at 4329 Crownwood Avenue for up to six children, subject to conditions recommended by city staff.
Staff presented the request and recommended approval with conditions: notarized written consent from the property owner, that the owner/operator be an inhabitant of the property, installation of play equipment coordinated with city staff, driveway parking area to be cleared and salted in snow conditions, and a minimum of 36 square feet of indoor play/learn space per child.
“Staff recommends approval of a request with the following conditions,” the staff report said, listing the items above and noting state licensure requirements under Ohio Revised Code chapter 5104. The application materials described the facility as Sky’s the Limit Child Care LLC and included floor plans, photo excerpts of interior spaces, and a parent handbook and employee policies.
Applicant Klache Allen (presented in the record as the owner/operator) told the board she aims to “give parents the opportunity to be able to work, go to school, fulfill their everyday needs, while knowing that their child is in a safe, nurturing environment.” Allen said enrollment initially would be small—five to six children—and that drop-off volume would be low; she also said she had already incorporated “quiet drop off hours” into her policies.
A nearby resident at 4343 Crownwood Avenue spoke during public comment, citing concerns about vehicle speeds on a curve near the property and requesting increased patrols or traffic-calming measures. “It is concerning… if you have other people parking on the street for neighborhood street parking… please consider some way that traffic could be” slowed, the neighbor said. Board members and staff noted that traffic-enforcement or traffic-calming measures are the purview of the police department and public works, and that residents should report concerns to Clayton Police for patrol consideration.
During findings of fact, a board member cited the application’s detailed operations materials, the property’s indoor and outdoor space, and the low projected drop-off volume in concluding the proposal met the standards for conditional use in the residential single-unit district. The board voted, by roll call, to approve the conditional use with the staff-recommended conditions.
Discussion vs. decision: the hearing included staff presentation, applicant testimony, and one public comment about traffic safety. The BZA’s formal decision was to grant the conditional-use certificate with the stated conditions; no additional direction to staff was recorded.
The decision allows the applicant to pursue required state licensing and to proceed with building/operational work subject to the conditions imposed by the board.
