Council approves conditional outdoor‑dining use for Ryan’s Rise Up Cafe with fencing, bollards and seating limits

Concord Township Council on Aug. 6 approved a conditional‑use decision permitting seasonal outdoor dining for Ryan’s Rise Up Cafe at 5 Evergreen Drive (Suite 100), adopting Resolution 33 of 2025.

The council’s vote followed a prior public hearing; the resolution permits outdoor dining April 1 through Nov. 1 and confines the seating area to the footprint shown on the submitted architectural plan. The approval is limited to the current tenant and ceases upon termination of the applicant’s tenancy.

Conditions include a minimum 48‑inch fence around the outdoor dining area; protective bollards and a guardrail adjacent to vehicle drive aisles, located as approved by the township engineer; excavation and paver installation where tables occupy landscaped areas; a prohibition on live music or entertainment in the outdoor area; and a no‑smoking requirement. The council also limited the number of outdoor tables and seats in the resolution: “The number of outdoors dining tables may not exceed six 24‑inch‑wide two‑top tables and outdoor seating is limited to 12,” as read into the record.

Council President noted the applicant had agreed to protective measures including guide rails or bollards and fencing similar to other outdoor dining approvals. The council moved, seconded and approved Resolution 33 of 2025 by voice vote. No roll‑call tally was recorded in the meeting transcript.

The township engineer must approve the final positions of bollards and guardrails adjacent to drive aisles before outdoor seating may be implemented. The approval explicitly disallows live entertainment and smoking in the outdoor area and is conditionally limited to the applicant’s tenancy.
