Planning board approves code amendment to limit docks in mouth of Lake Huntington channel

The Planning Board on Aug. 11 recommended a text amendment to the Unified Land Development Code to define and protect the navigation channel at the mouth of Lake Huntington by prohibiting docks and boat slips in a mapped area. Staff explained the proposal responds to a recent dock appeal and would geographically define a prohibited area (described in the draft ordinance and shown on maps) so docks within that area become nonconforming structures. If the city commission adopts the ordinance, existing nonconforming docks could remain but may not be extended or rebuilt if damaged beyond 50% of their value unless rebuilt outside the defined zone. Staff said the change is currently focused on the Lake Huntington channel but could be expanded to other channels following stakeholder input. Board members discussed concerns about appearing to target a single property and the difficulty of proving that a dock "impedes navigation" in prior appeals; staff said the draft initially considered language to bar docks that "adversely affect" navigation but retained the existing standard using the term "impede" after resident feedback. The board voted 5‑0 to recommend the amendment.
