Board delegates authority to superintendent to execute attendance-credit purchase under Chapter 49 recapture option

District staff summarized five statutorily authorized options to reduce district wealth, including consolidation, detach/attach property, purchase of attendance credits, contracting for education of nonresident students, and tax-base consolidation. "Option 3, purchase of attendance credits. A district with wealth above the required statutory threshold may purchase attendance credits from the state and this is the option that most districts use and we've also used this 1 in the past," staff said.
Trustees unanimously approved a motion delegating contractual authority to the superintendent to obligate the district under TEC 48.257 and related code sections and Commissioner rules for purposes of purchasing attendance credits or related funding-netting agreements for the 2025-26 school year.
